Healthcare reforms in India have been a much-debated issue in the recent past. While the debate has focused mainly on the right to healthcare, another by-product that has evolved out of the debate was the current problem of medical malpractice and the healthcare law. The last decade has seen an increase in the healthcare facilities in the country. This, however, has come with a bulk of medical error cases which the courts have entertained. According to reports, there has been an (...) increase in medical litigation cases by 400% in the last decade. There are about 5.2 million cases of medical error in the country every year. While there exists a standard legal system in the country which entertains such complaints of medical malpractice, the attempt by regulators and medical practitioners should be to reduce these cases. This paper seeks to analyze the extent to which medical malpractice cases affect consumers. It analyzes the existing medical liability system which has mainly evolved through the jurisprudence laid down by the English courts and critiques it. It also looks into the major reasons for such medical mishaps. Authors argue that a “No-Fault” system may give better outcomes. They analyze this by looking at the no-fault liability model implemented in New Zealand. Narratives of no-fault liability being implemented in India have also been used. These are showcased from instances of Motor Vehicles Act, 1988, and Clinical Trial regulations. It is also argued that a by-product of a no-fault liability system is stringent regulations which are used to reduce the possibility of medical mishaps altogether. Lastly, the possible problems of the no-fault liability system are discussed in the paper. (shrink)

It distinguishes between ‘positive’ political power appropriately wielded by the state, and ‘negative’ power that individuals may use to protect their own activities and interests from excessive or illegitimate state action and argue for institutions and practices designed to equalize power by ‘leveling up’ the powerless to match (...) the strong. The COVID-19 pandemic caused university education to transition from face-to-face contacts to virtual learning environments. Young adults were forced to live an entirely new life online, without valuable and enjoyable social interaction. We examined subjective perspectives towards life online during the pandemic. We identified four viewpoints about life mediated by computers. Two viewpoints express “struggling”: Viewpoint 1 (Angry, Depressed and Overwhelmed), and Viewpoint 3 (Restricted to and Overwhelmed by Virtuality). A third feeling-state conveys experiences of “surviving”: Viewpoint 4 (Isolated and (...) Powerless in Convenience). Surprisingly, Viewpoint 2 is about “thriving” (Comfortable and Convenient Routine with Computers). The research shows that virtualization, confinement, and anxiety are taking a toll on the mental health of some members of the younger generation, while at the same time other members feel they are thriving in a situation of limited resources, virtuality, and reduced face-to-face human interaction. Rapid handwriting, popularly known as shorthand, involves writing symbols and abbreviations in lieu of common words or phrases. This method increases the speed of transcription and is primarily used to record oral dictation. Someone skilled in shorthand will be able to write as fast as the dictation occurs, and these patterns are later transliterated into actual, natural language words. A new kind of rapid handwriting scheme is proposed, called the Pattern-Based Shorthand. A word on a keyboard involves pressing a unique (...) sequence of keys in a particular order. This sequence forms a pattern that defines the word. Such a pattern forms the shorthand for that word. Speech recognition involves identifying, by a machine, the words spoken by a speaker. These spoken words form speech input signals to a computer that is equipped to correctly recognize the words and do further action, such as convert it to text. From this text input, unique shorthand patterns are generated by the system. The system employs machine learning to improve its performance with experience, by creating a dictionary of mappings from word to patterns in such a way that the access to existing patterns is faster with progression. This forms a new knowledge representation schema that reduces the redundancy in the storage of words and the length of information content. In conclusion, the speech is converted into textual form and then reconstructed into Pattern-Based Shorthand. (shrink)

Commentators are divided on the interpretation of Metaphysics Z4 1029b13–22. For one thing, it is unclear whether the passage rejects a claim about the essence of surface, or about the essence of pale. It is usually thought that the claim is disavowed because it involves a circular definition. However, this is conjectural, since Aristotle does not explicitly say anything about circularity in the lines in question. I argue here for an alternative account, which reads the disputed lines as an extension (...) of the immediately preceding remarks. If correct, this also solves the problem as to just what Aristotle is denying. As will emerge, my story is helped by St. Thomas’ reading of lines 21–22, an account that has been curiously ignored in the recent literature. (shrink)

It has been claimed that the earliest expression of a robust scepticism is in the Catalogue of Ships in theIliad, and even commentators who would not go that far have thought the passage an important guide to epistemological attitudes in Homeric antiquity. It will be argued here that a close examination of the text does not support such conclusions. On the other hand, there are respectable reasons for an interpretation in which religious factors are operative, rather than epistemic ones. One implication of Bell’s theorem is that there cannot in general be hidden variable models for quantum mechanics that both are noncontextual and retain the structure of a classical probability space. Thus, some hidden variable programs aim to retain noncontextuality at the cost of using a generalization of the Kolmogorov probability axioms. We generalize a theorem of Feintzeig to show that such programs are committed to the existence of a finite null cover for some quantum mechanical experiments, i.e., a finite (...) collection of probability zero events whose disjunction exhausts the space of experimental possibilities. The significance of teaching to the evolution of human culture is under debate. We contribute to the discussion by using a quantitative, cross-cultural comparative approach to investigate the role of teaching in the lives of children in two small-scale societies: Aka foragers and Ngandu farmers of the Central African Republic. Focal follows with behavior coding were used to record social learning experiences of children aged 4 to 16 during daily life. “Teaching” was coded based on a functional definition from evolutionary (...) biology. Frequencies, contexts, and subtypes of teaching as well as the identity of teachers were analyzed. Teaching was rare compared to observational learning, although both forms of social learning were negatively correlated with age. Children received teaching from a variety of individuals, and they also engaged in teaching. Several teaching types were observed, including instruction, negative feedback, and commands. Statistical differences in the distribution of teaching types and the identity of teachers corresponded with contrasting forager vs. farmer foundational cultural schema. For example, Aka children received less instruction, which empirically limits autonomous learning, and were as likely to receive instruction and negative feedback from other children as they were from adults. Commands, however, exhibited a different pattern suggesting a more complex role for this teaching type. Although consistent with claims that teaching is relatively rare in small-scale societies, this evidence supports the conclusion that teaching is a universal, early emerging cognitive ability in humans. The underlying psychological processes that enable framing effects are often described as cognitive. Yet, recent studies suggest that framing effects may also be mediated by emotional response. The role of specific emotions in mediating the framing effect process, however, has yet to be fully empirically investigated. In an experimental survey design, this study tests two positive and two negative emotions as mediators of framing effects. Our results show that while anger and enthusiasm mediate a framing effect, contentment and fear do (...) not. These findings deepen our understanding of which discrete emotions are relevant when studying mediated framing effects. (shrink)
